UAE top court orders retrial in Dh870,000 fraud case

## Background

The UAE's Federal Supreme Court has mandated a retrial in a fraud case involving four defendants accused of attempting to deceive a man into withdrawing a lawsuit. The defendants allegedly misled the complainant by presenting an envelope they claimed contained Dh870,000, prompting him to sign a waiver.

## Discovery of Fraud

After signing the waiver, the complainant discovered that the envelope actually contained only Dh4,000 in small denomination notes. This revelation led him to revoke the waiver, exposing the alleged fraud.

## Initial Court Rulings

A lower court found two of the defendants guilty of attempting to seize the funds, sentencing them to six months in prison. The other two defendants were acquitted. On appeal, one defendant's sentence was reduced to a Dh20,000 fine, while another's conviction was upheld.

## Supreme Court Decision

The Supreme Court ruled that the appeal court failed to address a crucial defense argument, which constituted a breach of the defendant's rights. As a result, the Supreme Court overturned the previous ruling and sent the case back to the Court of Appeal for further consideration.
