## Court Ruling on Medical Negligence
A Dubai court has mandated a hospital and a doctor to pay Dh100,000 in compensation to a couple following the loss of their unborn child. The court found that medical protocols were not adhered to during a crucial period of care.
## Details of the Case
The incident began when a pregnant woman noticed decreased fetal movement and sought medical help. An ultrasound revealed a weak heartbeat, but the attending doctor did not take immediate action, advising her to consult her primary physician instead. Unable to reach her regular doctor, the couple went to another hospital, where tests confirmed the fetus had died due to the umbilical cord being wrapped around its neck.
## Findings and Judgment
The Higher Committee for Medical Liability reported that timely intervention is critical in such situations. Although the committee did not directly link the delay to the fetus's death, it identified failures in immediate procedures such as fetal heart monitoring. The court emphasized that while doctors are not expected to guarantee outcomes, they must adhere to established medical standards. The failure to act promptly was deemed a breach of this duty.
## Compensation for Emotional Distress
The court dismissed financial compensation claims due to insufficient evidence but acknowledged the emotional distress caused by the delay and lack of immediate action. Consequently, the hospital and doctor were ordered to jointly pay the moral damages and cover legal costs.
