## Court Ruling on Fraud Case
An Abu Dhabi court has mandated a jailed fraudster to return Dh150,000 to his victim, along with an additional Dh10,000 as compensation. This decision was made by the Abu Dhabi Family and Civil, Administrative Claims Court following a civil lawsuit filed by the victim.
## Background of the Case
The victim accused the defendant of acquiring the money through fraudulent activities. The defendant had already been convicted in a related criminal case and is currently serving a prison sentence in another emirate for a separate offense. During the hearing, the defendant's wife, representing him under a power of attorney, argued for the dismissal of the lawsuit, claiming it was filed against the wrong party and lacked evidence.
## Court's Decision
The court rejected these arguments, emphasizing that the criminal conviction had already established the defendant's responsibility for the fraud. The court noted that the criminal judgment was final and binding in the civil case, confirming the fraud and the perpetrator's identity.
## Legal Implications
Citing the Civil Transactions Law, the court stated that no one may unlawfully take another's property and must return any such amount. Consequently, the defendant was ordered to repay the full amount of Dh150,000 and cover court fees and legal costs.
