## Court Decision
The Ras Al Khaimah Court of First Instance has annulled a one-year jail sentence for a 49-year-old Gulf national, instead imposing a fine of Dh10,000. This decision came after the court accepted the defendant's appeal, citing medical evidence and insufficient prosecution evidence.
## Incident Overview
The case originated from an incident on August 11, 2025, in Al Nakheel, where the defendant was accused of assault, property damage, and public intoxication. The complainant, an Indian grocery worker, alleged that the defendant, in a state of intoxication, caused a disturbance, assaulted him, and damaged property, including a mobile phone and a delivery motorcycle.
## Evidence and Defense
The prosecution's case was based on the complainant's testimony, medical reports, and repair invoices. However, the court noted the absence of CCTV footage and independent eyewitnesses. The defense, led by lawyer Hanan Salem Al Shimili, argued that the charges were fabricated and highlighted the defendant's medical conditions, including mental health disorders, which could exempt him from criminal responsibility.
## Legal Arguments
The defense invoked Article 62 of Federal Decree-Law No. 31 of 2021, arguing that the defendant's mental health issues should exempt him from criminal liability. Despite the court's ruling to replace the jail term with a fine, the defense has appealed for a full acquittal.
