## Court Ruling
The Khor Fakkan Appeals Court has acquitted a municipal tanker driver involved in a road accident in Dibba Al Hisn, ruling that the victim was solely responsible for the incident. This decision concludes a lengthy legal process that saw the driver initially convicted and fined, then sentenced to prison, before being cleared of all charges.
## Accident Details
The incident occurred on September 9, 2025, when the driver was operating a sewage suction truck. As he moved the vehicle from a stationary position, a 76-year-old pedestrian unexpectedly emerged from behind a parked car and attempted to cross the road in an unauthorized area. The pedestrian's actions placed him directly in the truck's path.
## Legal Proceedings
Initially, the Court of First Instance found the driver guilty of negligence and failing to stop after the accident, imposing a fine. The prosecution sought a harsher penalty, leading to an increased sentence by the Court of Appeals. However, the Court of Cassation later overturned this decision, citing gaps in the legal reasoning, and ordered a retrial.
## Defense Argument
The defense, led by lawyer Mohammed Al Awami Al Mansoori, successfully argued that the driver was unaware of the collision due to the vehicle's size and noise. They demonstrated that the victim's actions were the sole cause of the accident, as he crossed from behind a stationary vehicle without using a nearby sidewalk.
## Final Verdict
The court concluded that the pedestrian's behavior was the direct cause of the accident, breaking any causal link to the driver's actions. The judges emphasized that criminal convictions require certainty, and any doubt should favor the accused. Consequently, all previous judgments were canceled, and the driver was declared not guilty.
