Ask Gulf News: Can employees resign immediately after workplace harassment?

## Immediate Resignation Rights

In the UAE, employees facing workplace harassment have the right to resign immediately without serving a notice period. This is contingent upon informing the relevant authorities and the Ministry within five working days of being able to report the incident. This provision is outlined in Article 45(2) of the UAE Labor Federal Decree-Law.

## End-of-Service Entitlements

Employees who resign due to harassment are entitled to retain their end-of-service benefits. However, it is crucial to report the incident promptly to ensure these rights are preserved.

## Arbitrary Dismissal and Compensation

Workplace harassment does not qualify as a reason for claiming arbitrary dismissal under Article 47 of the Labour Law. Arbitrary dismissal claims are limited to cases where an employee is terminated for filing a serious complaint or initiating legal proceedings against the employer.

## Seeking Compensation

Employees can seek compensation for harassment, but the responsibility to prove the occurrence of harassment lies with them. The court will evaluate the evidence and decide on the compensation based on its findings.
